Client was at a bar and had one drink. She began to drive home and stopped at a traffic light. The client fell asleep at the light for four cycles of the light. A police officer arrived at her location and boxed her car in.
The client finally woke up after the officers knocked on her window several times. The client got out of her car and said she was tired from the day and just fell asleep. The officers believed she had passed out from drinking. She refused to do any field sobriety test and was arrested for DUI.
Attorney Blevins was able to show the prosecutors that the client was not intoxicated and merely fell asleep. The DUI charge was reduced to a reckless driving charge.
