Client was leaving work in Woodstock at 3:00 am. A Sheriff’s deputy stopped her for touching the center line. The deputy said he smelled marijuana coming from her breath and vehicle. The deputy began to search her vehicle. No marijuana or other drugs were discovered in the search. Another deputy arrived and said he smelled alcohol. Client was then arrested and charged with DUI, Reckless Driving, Failure to maintain lane and obstruction of an officer for not taking the blood test.
Attorney Blevins attempted to get the DUI dismissed, but the State refused to do so. Attorney Blevins took the case to a jury trial. Attorney Blevins was able to get a directed verdict of not guilty for the Reckless driving and Failure to maintain lance charges. A jury found the client not guilty of the other two charges of DUI and Obstruction of an officer. The jury deliberated for approximately 10 minutes.
