Chapter 7 is one type of bankruptcy that you can file for in Georgia when you are looking for relief from overwhelming debt. This is the type of bankruptcy that many people imagine when they picture a new fresh start from their financial hardship. The reason for this is because a debtor's unsecured debt is discharged. When debt is discharged, the debtor is free of it and will no longer have to worry about repaying it.
In this type of bankruptcy, your unsecured debts can be discharged. This does not include your spousal support or child support payments, your student loans or your taxes. The types of debts that can be discharged, include:
When considering the type of bankruptcy you are going to file for, you also need to determine your eligibility for either type of bankruptcy. In order to file for a Chapter 7, you need to undergo a means test. The purpose of this test is to look into your income and determine if you are able to repay any or all of your debts.
The first step is to compare your monthly income to the median household income for your state. If your income is below the median, you automatically qualify for this bankruptcy. If not, the test will then take into account your expenses and determine your disposable income. If your disposable income shows that you can indeed repay at least some of your debts, you may not qualify for a Chapter 7. If it shows an inability to repay debts, you may be eligible for a Chapter 7. For help through this testing process and filing for bankruptcy, it is advised to have a skilled Marietta bankruptcy lawyer by your side.
